These Terms of Service ("Terms") constitute a legally binding agreement between you ("you" or "user") and Conscious Living ("we," "us," or "our") governing your access to and use of the Mind Space mobile application and any related services (collectively, the "Service").
By downloading, installing, or using Mind Space, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.
These Terms apply to all users of Mind Space, including users in Guest Mode and registered account holders. You must be at least 13 years of age (or 16 in the EEA) to use the Service.
Mind Space is an AI-powered journaling and personal memory application developed and maintained by Conscious Living. The Service allows you to:
The Service is provided on an "as-is" basis. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with reasonable notice where possible.
Account Creation
You may use Mind Space in Guest Mode without creating an account. To access cloud sync and cross-device features, you must create an account using a valid email address and password, or authenticate via a supported third-party provider (such as Google Sign-In).

Account Security
You are responsible for maintaining the security of your account. Conscious Living cannot and will not be liable for any loss or damage arising from your failure to comply with this obligation. Do not share your password with others or reuse passwords from other services.
Account Termination by You
You may delete your account at any time through the app's Settings screen or by contacting support@mindspace.app. Deleting your account will permanently remove your cloud-stored data. Locally stored data must be cleared separately on your device.
Mind Space is designed as a personal journaling and wellness tool. You agree to use the Service only for its intended purpose and in compliance with all applicable laws and regulations.

Our Intellectual Property
The Mind Space application, including its design, graphics, interface, feature set, branding, and underlying code, is owned by Conscious Living and protected by applicable intellectual property laws. "Mind Space" and "Conscious Living" are trademarks of Conscious Living. You may not use our trademarks or trade dress without our prior written consent.
Your Content
You retain full ownership of all journal entries, memories, and other content you create within Mind Space ("Your Content"). We do not claim any ownership over Your Content.
By enabling optional cloud sync, you grant Conscious Living a limited, non-exclusive, worldwide license to store, process, and transmit Your Content solely for the purpose of providing the Service to you. This license terminates when you delete your data or your account.
You represent that you own or have the necessary rights to any content you create or upload, and that Your Content does not infringe any third-party intellectual property rights.
Mind Space includes AI-powered features to enhance your journaling experience. These features are provided as convenience tools and are subject to the following terms:
Voice Transcription
When you use the Voice Dictation feature, your voice recording is transmitted to Groq for transcription using the Whisper large-v3 model. By using this feature, you acknowledge that:
AI Summarization
The AI summarization feature uses Groq's LLaMA 3.1 language model to generate a concise summary of a journal entry when you request it. By using this feature:
AI Limitations and Disclaimer
AI features are provided as supplementary tools to assist your journaling practice. They are not a substitute for professional mental health advice, medical guidance, or counseling. Mind Space and its AI features are not a mental health service. If you are experiencing a mental health crisis, please contact a qualified mental health professional or emergency services.
Conscious Living does not use your journal content or AI interactions to train machine learning models. Your content is processed solely to deliver the requested feature in real time.
Your privacy is a foundational principle of Mind Space. Our collection and use of personal information in connection with the Service is described in detail in our Privacy Policy, which is incorporated into these Terms by reference.

The optional cloud sync feature uses Google Firebase Firestore to store and synchronize your journal data across devices. The following terms apply to cloud sync:
Opt-In Only
Cloud sync is never enabled by default. You must explicitly turn it on in the app's settings. You can disable it at any time, after which the app returns to fully local operation.
Data Availability
While we take reasonable measures to ensure the reliability of the cloud sync feature, we do not guarantee 100% uptime or data availability. Cloud sync depends on Google Firebase infrastructure, which is subject to Google's own service terms. We are not liable for data loss resulting from Firebase service outages.
User Responsibility
You are responsible for maintaining the security of your account credentials. If your account is compromised, contact us immediately. We strongly recommend enabling two-factor authentication if available on your sign-in method.
Data Retention
Cloud-synced data is retained until you delete it through the app or request account deletion. We do not independently delete your cloud data unless required by law or unless your account has been terminated due to a violation of these Terms.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Some jurisdictions do not allow the exclusion of implied warranties. In such jurisdictions, the above exclusions apply to the fullest extent permitted by law.
Mental Health Notice: Mind Space is a journaling and productivity tool, not a medical or mental health service. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CONSCIOUS LIVING, ITS OFFICERS, DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH:
IN NO EVENT SHALL CONSCIOUS LIVING'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED US DOLLARS ($100).
The limitations in this section apply regardless of the legal theory on which the claim is based. Some jurisdictions do not allow certain limitations of liability. In such jurisdictions, our liability is limited to the fullest extent permitted by law.
Termination by You
You may stop using Mind Space at any time by uninstalling the app. If you have a cloud account, you may delete your account via Settings or by contacting support@mindspace.app. Termination is effective immediately and will result in deletion of your cloud-stored data.

We reserve the right to suspend or terminate your access to the Service, with or without notice, if:
Effect of Termination
Upon termination, your right to use the Service immediately ceases. Locally stored data on your device is not automatically deleted by termination — you remain responsible for managing data on your own device. Cloud-stored data will be deleted in accordance with our Privacy Policy.
Sections of these Terms that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, and governing law — will survive.
These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising out of or relating to these Terms or the Service will be resolved through good-faith negotiation between the parties.
If a dispute cannot be resolved informally, both parties agree to submit to the exclusive jurisdiction of the courts with authority over the matter. If any provision of these Terms is found to be unenforceable or invalid, that provision shall be modified to the minimum extent necessary to make it enforceable, and all other provisions shall remain in full force and effect.
The failure of Conscious Living to enforce any right or provision of these Terms will not be considered a waiver of those rights. These Terms constitute the entire agreement between you and Conscious Living regarding the Service and supersede all prior agreements.
